The Case
Serhii Sternenko - Odessa public figure, lawyer and blogger.
In Odessa, he was attacked 3 times, during the last one Serhiy wounded one of the attackers, Ivan Kuznetsov, who later died.
In 2020, after the appointment of Iryna Venediktova as the Prosecutor General of Ukraine and under her pressure, Sternenko was charged under Art. 115 of the Criminal Code "Intentional murder" and Art. 222 of the Criminal Code "Illegal carrying, storage, acquisition, manufacture and sale of firearms or melee weapons, ammunition and explosives".
Sternenko emphasizes: he defended himself and acted in accordance with the article on necessary defense. None of the witnesses confirmed that he finished off the attacker. There is no evidence of premeditated murder in the case, and the examination confirmed that the knife is not a cold weapon.
According to Sternenko, the case materials describe actions that fall under Article 116 of the Criminal Code "Intentional murder in a state of strong mental excitement", which is punishable by imprisonment for up to 5 years. Instead, prosecutors incriminate the article, under which they can be imprisoned for up to 15 years. The defendant's defense considers it an "unlawful desire to deprive him of his freedom."
On February 23, 2021, the Seaside District Court of Odesa convicted public activist, blogger Serhiy Sternenko for 7 years and 3 months with confiscation of ½ of the property.
This happened within the framework of the case "Scherbych v. Sternenko and Demchuk"
After a lengthy legal process and dozens of actions in support of Sternenko, the Primorsky District Court of Odesa (judges S.M. Kichmarenko, O.P. Shentsova, and D.Yu. Dontsov) closed the case regarding Serhiy Sternenko's defense counsel.
On June 9, the Primorsky District Court of Odesa announced the sentence to Baimukashev Abzal Amangaliyovych in the case of the attempt on Serhiy Sternenko, which took place on May 1, 2018
