On August 31, 2020, the disciplinary chamber of the Ministry of Justice of Ukraine issued a reprimand for the so-called portrait-psychological examination in the "Sheremet case", which used a non-existent methodology (see the next point).
Scandals
In the summer of 2020, the Ministry of Justice of Ukraine opened proceedings based on a disciplinary complaint by the lawyer of the accused Yulia Kuzmenko, Taras Bezpaly, against KNDISE experts Semenets and Irkhin, because they conducted a portrait-psychological examination, comparing two video recordings of the gait, which contradicts the methodology. The lawyer stressed that it is impossible to do this. At the same time, five specialized expert institutes, at the request of the defense to conduct similar examinations, said that it is impossible to conduct them, because it is not provided for by the current legislation. Experts from other institutes of scientific expertise refused to conduct such an examination, because they are convinced that it is impossible to "recognize" people by video as part of a psychological study.
In addition, according to the Ministry of Justice, there is no corresponding method in the register: it is not scientifically based and certified. The Ministry of Justice noted that the examinations were not based on the methodology, but were based on the personal opinion of specialists. Conducting an examination using an unregistered method contradicts the "Instructions on the Appointment and Conduct of Forensic Examinations and Expert Studies". On August 31, 2020, experts Semenets and Irhin were brought to disciplinary action.
Experts of the Ministry of Internal Affairs previously determined that the video recordings are unsuitable for comparison, but the prosecutor's office still considers the KNDISE examination to be a key piece of evidence and went to court with it to consider the merits of the case.
