On August 31, 2020, the disciplinary chamber of the Ministry of Justice of Ukraine issued a reprimand for the so-called portrait-psychological examination in the "Sheremet case", which used a non-existent methodology (see the next point).

Scandals

In the summer of 2020, the Ministry of Justice of Ukraine opened proceedings based on a disciplinary complaint by the lawyer of the accused Yulia Kuzmenko, Taras Bezpaly, against KNDISE experts Semenets and Irkhin, because they conducted a portrait-psychological examination, comparing two video recordings of the gait, which contradicts the methodology. The lawyer stressed that it is impossible to do this. At the same time, five specialized expert institutes, at the request of the defense to conduct similar examinations, said that it is impossible to conduct them, because it is not provided for by the current legislation. Experts from other institutes of scientific expertise refused to conduct such an examination, because they are convinced that it is impossible to "recognize" people by video as part of a psychological study.

In addition, according to the Ministry of Justice, there is no corresponding method in the register: it is not scientifically based and certified. The Ministry of Justice noted that the examinations were not based on the methodology, but were based on the personal opinion of specialists. Conducting an examination using an unregistered method contradicts the "Instructions on the Appointment and Conduct of Forensic Examinations and Expert Studies". On August 31, 2020, experts Semenets and Irhin were brought to disciplinary action.

Experts of the Ministry of Internal Affairs previously determined that the video recordings are unsuitable for comparison, but the prosecutor's office still considers the KNDISE examination to be a key piece of evidence and went to court with it to consider the merits of the case.

In 2019, the judge of the Pechersk District Court of Kyiv, Serhiy Vovk, satisfied the lawsuit of former Yanukovych adviser Andrii Portnov for the protection of honor and dignity and decided to collect almost 7 million hryvnias from the state budget in his favor. During the August 2 hearing, Portnova's lawyer stated that the Canadian government continued sanctions against her client based on letters from the prosecutor's office. They allegedly wrote a lie about Portnov's involvement in violations of the law.

On September 2, 2020, Judge Vovk made an "exotic" decision, with which, at an intermediate stage of the process, he satisfied the demands of six British companies of brothers Hryhoriy and Ihor Surkis to write off 350 million US dollars from the state-owned "PrivatBank" in their favor, even without winning the entire proceedings on the merits. "PrivatBank" claims that the plaintiffs used the so-called "fan" scheme to bypass the automatic system of distributing cases among judges: the Surkis companies submitted three almost identical applications at the same time, after which they withdrew two of them, leaving only the one that was considered by Vovka. At that time, he had another, related case under consideration.

Dishonesty

(presence of circumstances indicating a probable violation by the pursuer of the Law of Ukraine "On Prevention of Corruption"):

In 2009, the Kyiv prosecutor's office opened a criminal case against Vovka for forging and using a forged court decision, stealing a civil case and fraudulently taking possession of a 70-hectare plot of land. The corresponding decision was made as a result of the review of the court's activities.
"In particular, it was established that the judge of the Pechersk District Court S. Vovk, in violation of the requirements of the law, issued a decision by which he recognized the ownership right of 0.10 hectares for each plaintiff (a total of 4.3 hectares) on French Boulevard in the city of Odessa" , - said Moskal.
"At the same time, the judge, exceeding his official powers, without reference to the norms of substantive law, illegally changed the purpose of the land from recreational to land for the construction and maintenance of a residential building and farm buildings and structures," the deputy claims.

After the Revolution, the dignity of the Wolf was announced suspicion in the adoption of a known unjust decision, by which he took the car and apartment from the citizen in absentia. However, in January 2020, the Vyshgorod District Court of the Kyiv Region declared him innocent and acquitted the judge.

Investigative Department of the Prosecutor's Office of the city of Kyiv in June 2015, the pre-trial investigation in the criminal proceedings against the judge of the Pechersk District Court of the capital Serhiy Vovka was completed. As reported, S. Vovk is suspected of abusing his official position and deliberately violating the requirements of the law, making a knowingly unjust decision in a civil case. By his decision, the judge illegally deprived the citizen of the right of ownership of the property belonging to him. The specified criminal offense is classified under part 2 Art. 375 of the Criminal Code of Ukraine (provision of a knowingly unjust decision by a judge). However, the Court of Appeal of the city of Kyiv refused the Kyiv Prosecutor's Office to keep the judge of the Pechersk Court Serhiy Vovka in custody.

On January 15, 2020, the Vyshgorod District Court of the Kyiv Region found Serhiy Vovka innocent in this case.

The General Prosecutor's Office of Ukraine (GPU) has started criminal proceedings against the judge of the Pechersk District Court of Kyiv, Serhii Vovk, for the fact that he unblocked funds from the accounts of the former Minister of Agriculture Mykola Prysiazhniuk. This was stated by the Deputy Prosecutor General of Ukraine, Oleksiy Baganets, reports Espresso.TV.

Journalists of the publication "Ukrainian Week" suspected judge Serhiy Vovka of the inconsistency of the rate of accumulation of property and his income. Yes, it was said that in 2010, the judge, despite not having such a large salary (in 2010, he received 77,290 hryvnias, 6,114 of which was material assistance - about 6,500 hryvnias for monthly expenses), had already managed to earn money for an apartment with an area of 205 square meters, a plot of land with an area of 1,800 square meters, a Ford truck. And also Toyota and Honda cars for the family - in particular, the young wife of the 40-year-old judge, Ksenia Mykhailivna.
The year 2011 brought the honest (at least, more frank than his colleagues when filling out declarations) judge 960 new square meters of "golden" land near the Black Sea in the village of Karolino-Bugaz (Odesa region), 760 "squares" near the same sea in the village of Zatoka (also Odesa), two previously missing apartments in Odesa (24.3 and 177 square meters). He also indicated in the last declaration the tiny premises belonging to his family members in the capital - 13.4 and 9.5 square meters

Disciplinary sanctions and punishments

Serhiy Vovka was suspended from work five times, but every time he returned to work at the Pechersk Court of Kyiv.
March 1, 2011 — the Supreme Council of Justice dismissed Vovka from the post of judge of the Pechersk District Court for violating the oath.
March 10, 2015 — At the meeting of the High Qualification Commission of Judges of Ukraine, based on the request of the Prosecutor General of Ukraine a decision was made remove 5 judges from their positions, including Serhiy Vovka.
In February 2016, Vovk returned to work, the GPU appealed to VKKS to remove Vovk from his post.
April 4, 2016 — for by the decision of the Higher Qualification Commission Vovka judges were suspended from work for two months. This was the fifth case of suspension.

Scandals

The Pechersk District Court ordered the Prosecutor General's Office to remove from the Unified Register of Pre-Trial Investigations the information about the notice of suspicion to the head of the District Administrative Court, Pavlo Vovka, due to its "improper delivery". After studying the complaint, investigating judge Serhiy Vovk of the Pechersk Court satisfied it and ordered the OGP to exclude the information about the serving of suspicion on the head of the OASK, Pavlo Vovk. He established that the head of the court was improperly served with the suspicion while he was on vacation. Also, the detectives allegedly sent suspicion to Vovka at the wrong address.

On July 5, the Pecherskyi District Court of Kyiv granted the request of "Privatofis" LLC, related to Ihor Kolomoisky, and lifted the seizure of 415 real estate objects of the company. This is stated in the court decision published in the Unified Register of Court Decisions on July 12, reports "Interfax-Ukraine". The judge came to the conclusion that "the seizure was imposed without evidence of proportionality of the value of the immovable property, on which the seizure was imposed, with the amount of damage caused by the criminal offense," the case file states.

During an unannounced session late on June 6, the Pechersk District Court of Kyiv rejected the request of the investigation to extend the detention period of the main suspect in the organization of the murder of the Berdyan activist, a participant in the hostilities in Donbas, Vitaly "Sarmat" Oleshko - Mykhailo Sigida. Judge Serhiy Vovk decided to release Sigida from custody to house arrest.
More details - Radio Svoboda material.

In December 2020, he praised the decision to transfer the case against the Deputy Head of the Office of the President Oleg Tatarov from the National Anti-Corruption Bureau (NABU) to the State Bureau of Investigation (SBI). As noted in the anti-corruption prosecutor's office, judge Vovk, by making such a decision, went beyond the limits of the powers granted to him. The SAP emphasizes that the determination of liability is not the competence of a judge - it can be done by the prosecutor (Part 5 of Article 218 of the Criminal Procedure Code). Also, according to the special prosecutor's office, there is a ban on the transfer of cases investigated by NABU to another law enforcement agency (Part 5 of Article 36 of the Criminal Procedure Code).

Biography

According to the site data Fair, from 1998 to 2011, Pysanets Vitaliy Anatolyevich was a judge of the Sverdlovsk City Court of the Luhansk Region (from 2003 elected to the position of judge for an indefinite term). In 2011, his assigned Chairman of the Sverdlovsk City Court of the Luhansk Region.

In 2012, an incident happened to him that became widely publicized: On July 22, unknown persons beat the head of the Sverdlovsk City Court of the Luhansk region, Vitaliy Pysanets.About this wrote many media outlets, indicating that the reason for the attack was “professional activity.” Without specifying what the exact cause was.

According to her, Pysants was taken to a hospital in Sverdlovsk with a fractured skull and severe hemorrhage. Later, he was transferred to intensive care in Luhansk and is in serious condition there. The wife also reported that her son-in-law is in the traumatology department of the Sverdlovsk city hospital with moderate injuries, wrote TSN.

Some The media wrotethat the attack was carried out due to the judge's failure to fulfill certain obligations to the criminal community. Although, in the end, it could have been banal hooliganism related to the behavior of the judge himself, who could feel like the master of the city.

In 2015, by Decree of the President of Ukraine, he was transferred to the most “trump” and influential Kyiv-Pecherský court. Interestingly, the decree is dated April 2015, the judge moved to the territories controlled by Ukraine in the fall of 2014. And before that, did he somehow coexist with the militants and occupiers?

The “Pechersk” period

In January 2019, the Pechersk Court of Kyiv canceled the arrest property of the Dutch company "LVV Administrative Bureau Foundation", which the Prosecutor General's Office links to the fugitive, former Minister of Internal Affairs Vitaly Zakharchenko. This includes 20 land plots, three residential buildings, as well as an apartment in Kyiv and two parking spaces. All this property was arrested in 2014 as part of the case of illegal enrichment and money laundering by Vitaly Zakharchenko. This decision It was Vitaly Pysanets who approved it..

In 2016 he made a similar decision regarding the assets of another fugitive regionalist, Serhiy Arbuzov. And in May 2019 The media reported, that the GPU sees the "interest" of the judge of Pechersk Court of the city of Kyiv Vitaly Pysanets in favor of Oleg Repa - the developer of the scandalous long-term residential complex "Shevchenkivskyi kvartal". As a result, The media called his “handy judge Poroshenko.”

Scandals

  • in 2020, he rejected the prosecutor's office's request to arrest Interior Ministry employee Artem Yeltsov, who had previously initiated criminal proceedings against participants in the Revolution of Dignity;

However, later the Pechersk District Court of Kyiv again made an arrest on the property of unnamed foreign companies associated with the former head of the Ministry of Internal Affairs (the list was similar - three apartments; six garages in the central part of Kyiv; four residential buildings; 24 land plots);
  • in 2018 he was reinstated in his position Kateryna Amosova, rector of the O.O. Bogomolets National Medical University, declared the order of the Ministry of Health of Ukraine on her dismissal illegal and canceled it;

Then, as if in violation of the principle of presumption of innocence, searches and seizure of property were carried out on the basis of "belonging to the criminal world."

Vadym Dzyubynskyi was at the helm of the Kovpakiv district police department of Sumy, when on January 17, 2012, Oleksiy Khodakov, a 32-year-old resident of Sumy, died there, handcuffed behind his back. Physical injuries and injuries of internal organs were found on his body. A few months later, three policemen were detained on suspicion of beating Khodakov: Bohdan Sobyna, Mykola Tertychny, and Dmytro Moskalenko. The investigation had no official complaints against Vadym Dzyubynskyi. The three detainees spent almost two years in the SIZO. Dzyubinsky supported them all this time. And after the head of the Sumy District Court, Ihor Dashutin, changed the preventive measure against the law enforcement officers, releasing them, and the accused policemen returned to work, one of them - Dmytro Moskalenko - transferred to the Department of Internal Security of the Sumy Region Police, which was headed by Vadym Dzyubynskyi. By the way, the trial of the policemen is still ongoing. And, in connection with the victory of judge Ihor Dashutin in the competition for the Supreme Court, most likely, this case will be heard again from the beginning. And here it was not necessary to invite a person from Great Britain... Given that our results did not coincide with what the investigation hoped for... IN ether of the "Freedom of Speech of Savik Shuster" program, Ruvin stated that the results of the research of Ukrainian specialists "did not match what the investigation had hoped for" - that is why the law enforcement officers turned to him, the material says.

It is noted that in one of the tapes of Roman Truba's wiretap with Oleg Koretsky, the head of the First Department of the SBI's pre-trial investigation organization on September 3, you can hear how the former is angry that the latter summoned the fifth president Petro Poroshenko for questioning on the wrong case: "You thought to call him on the ground? We don't have adequate things to do?" Then he adds that he can solve "all problems with examinations with one phone call to Ruvin."

According to the journalists of the "Schemes" program, the director of the Kyiv Scientific Research Institute of Forensic Examinations Oleksandr Ruvin tried to cancel the key examination in the case of Roman Nasirov.

The suspicion of a criminal offense announced to the head of the State Fiscal Service, Roman Nasirov, is based on a key document - a forensic economic examination. It was conducted by two experts at the request of the National Anti-Corruption Bureau of Ukraine and they drew up their conclusion on November 30, 2016, establishing losses of over two billion hryvnias.

But on December 15, 2016, KNDISE director Oleksandr Ruvin informed NABU that the head of the Federal Tax Service Roman Nasirov allegedly provided additional materials of significant importance and asked to consider the forensic economic examination invalid.
