Why the portrait and psychological examination in the case of Sheremet cannot be evidence at all (documents)

The so-called main and only “evidence” of the investigation in the Sheremet case is the gait analysis. And again, there were falsifications, since this analysis cannot be evidence at all.

Experts from the KNDISE conducted a portrait-psychological examination and a forensic gait analysis and, in a categorical form, allegedly established the similarity of the gait of Yana Dugar, Yulia Kuzmenko, and Andriy Antonenko with the persons from the video surveillance cameras. Moreover, the experts strangely claim: these are the same persons, despite the fact that no examination gives a 100% conclusion.

Very rarely do courts take the conclusions of expert examinations as a basis. Whether to accept an expert examination as evidence or not is solely determined by the investigation. KNDISE expert Yuriy Irkhin called it a mystery why the investigation identified his expert examination as the main evidence. In his 30 years of activity, this is supposedly the first such case. But the most interesting thing is that the expert examination is not only questionable evidence of guilt, but also that it is impossible to conduct it at all!

Five specialized expert institutes across the country, at the request of the defense to conduct similar examinations, said that they could not conduct them, because this is not provided for by current legislation. The experts refused, because they are convinced that it is simply impossible to "recognize" people from a video within the framework of a psychological study.

In addition, according to the Ministry of Justice, there is no corresponding methodology for conducting gait examination in the registry at all. That is, the methodology of the KNIISE experts is not scientifically substantiated and certified.

Later, Irkhin himself also confessed: they say, the methodology is not ready yet, it is under development, it will be ready in a year or a half. As a result, in August of this year, the Ministry of Justice brought to disciplinary responsibility experts (KNDISE) Irkhin and Semenets, since such a methodology does not exist.

You understood everything correctly: Dugar, Kuzmenko, and Antonenko have been deprived of their freedom for almost a year on trumped-up charges, and the main “evidence” does not withstand any criticism and cannot be proof at all. Follow the Sheremet case, it is important.
