On December 14, Darya Kyyanenko, lawyer for Dnipropetrovsk Regional Council deputy Andriy Denysenko, filed a number of complaints against the actions of the investigation:
- take investigator Sergienko away,
- to take the entire group of investigators away,
- to cancel the decisions to suspend the pre-trial investigation.
Investigator Sergienko himself did not appear for the consideration of any complaint, although he was duly notified in advance. Prosecutor Maznytsia also did not come to the hearing, although he was in the courthouse.
The defense challenged the investigators because of their biased and arbitrary actions, in particular because they are hiding from the "suspect" Andriy Denysenko and his lawyer Darya Kyyanenko. Both Denysenko and Kyyanenko personally came to the investigative department, but to no avail: they were not allowed in and no one came to see them. Moreover, the senior investigator Sergiyenko blocked Andriy Denysenko on WhatsApp. This was discovered by accident when Denysenko tried to contact the investigator.
However, the court found no violations in the work of investigator Sergienko and his group of investigators, as if such an investigation is the way it should be.
By the way, there are more than ten investigators in the case.
Further. A few weeks ago, wanting to extend the pre-trial investigation period, which expired in the last days of November, investigator Sergienko arbitrarily violated the norms of the Code of Criminal Procedure and went against common sense. He put Andriy Denysenko on the wanted list and suspended the investigation. The stated reason is hiding from the investigation authorities. And this is taking into account the fact that the “suspect” Denysenko did not receive any summons for interrogation within the period prescribed by the Law.
In short: according to the law, a summons is served at least three days before the date of the summons, but the investigative department apparently doesn't know how to count to three.
A week passed, and investigator Hrytsenko from the group of investigators repeated this trick with a wanted announcement. Although Andriy Denisenko came to court hearings twice during this week. According to lawyer Daria Kyyanenko, the investigation is creating artificial evidence in order to send Andriy Denisenko to a pre-trial detention center. But again, the court ruled to reject both complaints. The rulings are not subject to appeal. By the way, in the evening of the same day, after a session of the Dnipropetrovsk Regional Council, investigator Sergienko and unknown persons led by him ambushed Andriy Denisenko near the house. Violating the right to defense, without a lawyer, investigator Sergienko planned to conduct investigative actions almost on the street, in the open air. Having reasonedly refused, Andriy Denisenko went to the entrance, where the attack by unknown persons occurred.

Such legal nihilism and arbitrariness show only one thing: this case is fabricated, and it is being manipulated on the knee to fit the necessary political order of Svyatoslav Oliynyk, the former head of the Dnipropetrovsk Regional Council, and now a regional council deputy from the Servant of the People party and the head of the standing committee on culture and spirituality.
