On April 1, Judge Konstantin Pashchenko of the District Administrative Court in Kyiv ruled to declare unlawful and cancel the decision No. 1 of the Disciplinary Chamber of the Central Expert Qualification Commission under the Ministry of Justice of Ukraine dated August 31, 2020 regarding violations in the investigative examinations in the case of P. Sheremet.
The decision was made without the party filing a complaint against the expert, since the odious judges of the OASC were afraid of public publicity. Recall that lawyer Taras Bezpaly filed a complaint with the Ministry of Justice on behalf of Yulia Kuzmenko against the expert conclusion of the comprehensive examination (portrait, psychological and gait examination). The Commission under the Ministry of Justice of Ukraine established that the psychological examination in the comprehensive examination was conducted by experts Yuriy Irkhin and Andriy Sementes with violations, as they went beyond their competence and used a non-existent methodology for the study. Accordingly, the experts were brought to disciplinary responsibility.
Interesting fact: On 16.12.20, the Public Integrity Council revealed data that provide grounds for concluding that Judge Pashchenko does not comply with the criteria of integrity and professional ethics. In particular, this includes avoiding property declaration, violating the rights and freedoms of citizens during trials, making decisions while not at work, and covering up for Judge Vovk. The Lawmaker Initiative is preparing materials to include Pashchenko in the database of persons carrying out politically motivated criminal prosecutions.
We demand that the Parliament immediately liquidate the Kyiv District Administrative Court. Delaying the liquidation of the Kyiv District Administrative Court is a threat to the basic constitutional rights and freedoms of Ukrainian citizens.
