Enemies are sought among their own: how the prosecutor's office and police are persecuting businesses in frontline regions

While the Russians are shelling Zaporizhia, 30 km from the front, local prosecutors and the Department of Strategic Investigations (DSI) of the National Police are busy with a "more serious" matter - they are fighting with... a ditch.

An enterprise that recycles industrial waste has been searched, criminally prosecuted, and suspended for allegedly dousing waste with water. This is standard practice to prevent dust from spreading, which, on the contrary, reduces the harmful impact on the environment. But prosecutors decided that an “ecological disaster” under Part 2 of Article 242 of the Criminal Code of Ukraine is taking place here – an article that provides for liability for mass poisonings and deaths.

What does this mean for business?
An enterprise that creates jobs and pays taxes (11 million UAH of VAT for half a year) instead of working spends resources on courts. Its equipment is seized, and its reputation is destroyed by groundless investigations.

What did the court say?
The Third Administrative Court of Appeal declared the inspection illegal. This means that all subsequent actions by the prosecutor's office and the police were groundless. The decision was made by the judges Dobrodniak I.Yu. (speaker), Byshevska N.A. and Semenenko Ya.V.

And even earlier, in September 2024, Zaporizhzhia Court of Appeal lifted the seizure of the company's equipment. The judges Gonchar O.S., Dadasheva S.V. and Razzuzhdai V.Ya. confirmed the absence of grounds for criminal prosecution.

Not a coincidence, but a systematic practice
This is not the first time that law enforcement officers have persecuted their own citizens instead of fighting real crimes. Just like how a soldier is currently being tried for serving in the Armed Forces of Ukraine (The Shrek case), the law enforcement system is looking for enemies among its own.
