Here are the blatant violations in the Riffmaster case by the prosecutor's office and judges:
Violation of the European Convention on Human Rights. The prosecutor's office files a motion to extend the preventive measure with violations of the time limit, but the European Court of Human Rights recognizes this as a substantial violation. At the same time, the investigating judges, instead of the ECHR, allow themselves to decide which violations are substantial and which are not.
Violation of Antonenko's right to a reasonable time for the case to be heard. Sessions are scheduled sluggishly – twice a month, but even on this schedule they are not held. While the judges were allegedly ill, Antonenko was held in custody without evidence.
Violation of the adversarial principle. The judges do not examine the evidence of Andriy's innocence in the case file at all, but only evaluate the evidence of the prosecutors. The judges actually take the prosecutors at their word, as they do not examine the video from the surveillance cameras, which should be the subject of the investigation. The case contains incomplete video recordings of persons allegedly involved in the murder of journalist Pavlo Sheremet. However, there are no reference videos depicting Antonenko in the case file at all.
Violation of the principle of equality of arms. The judges chose milder preventive measures for the other defendants in this case, despite the fact that no evidence and no new circumstances were provided to substantiate Antonenko's involvement in the crime. The prolonged detention of a special forces officer, a volunteer at a medical hospital, and a military musician is unjustified. The defense eliminated all risks, and only the severity of the accusation cannot be a basis for prolonged detention. Instead, Antonenko's morality, place of residence, family ties, property status, lack of criminal records, place of work, and reputation are once again not taken into account. Prosecutors have been artificially keeping the risk of flight abroad relevant for a year now, because they still do not take away the passports. Once again, the lawyers tried to hand over the passports for safekeeping to show that the risk has been eliminated. However, today, prosecutor Tishin also called the presence of passports a real risk of flight and again did not take them away.
Prosecutor Mykhailo Tishin lied in court. here's what it's about:
The false alibi of the witness Andriy Yermilov, most likely sent by the prosecutor's office, allegedly indicates possible pressure from the suspect on the witnesses. This is what the prosecutor believes. However, the defense never referred to the testimony of this witness, did not request to question him in court, and even independently checked this alibi and refuted it. It turned out that Yermilov was mistaken in the dates, and told journalists false information after consulting with the then Deputy Prosecutor General Viktor Chumak. So isn't this the influence of the prosecutor's office, not Antonenko, on the witness? Today, the court asked the prosecutor how Antonenko was involved in Yermilov's testimony, but he was unable to answer. At first, he said listlessly that he was not at the trial. And then he added: “The prosecution assesses this as a fact of influence through unidentified individuals. I still believe that such testimonies are not joked about and are not simply expressed.” Does this conclusion of the prosecutor indicate that Antonenko influenced the witness?
The prosecutor allegedly did not know the military specialty of the person against whom he had been publicly supporting the accusation for a long time. When asked by the court, Tishin hypocritically appealed that Antonenko could say this. The judges noted that the ability to shoot a weapon alone is not enough to justify the risk of committing another offense. However, in the prosecutor's opinion, if Antonenko is a serviceman, then he can definitely commit an offense... How do you like that? Andriy Antonenko has been a soldier in the press service of the Special Operations Forces since 2017, his military registration specialty is a driver-mechanic, his duties include exclusively creating a positive image of a special forces officer and motivation for the fighters.
To your attention – Riffmaster's speech at the trial:
“I haven’t understood what’s going on in this case for a whole year. I’m being held for something I have nothing to do with. As for the motives: first they made me the organizer of the murder and the person who made the explosive, then that too disappeared from suspicion. Then they made us people with low moral qualities. Yulia Kuzmenko is a person who saved thousands of lives and saved children at the front. Is this the characteristic of a person with low moral qualities? Yana Dugar also saved more than one soldier. And I have more than 30 awards for patriotic education of servicemen. So we, with low moral qualities, responded to the call of unidentified persons to kill an unknown journalist? Do they have Wolf Messing in the police station? How does this fit on their heads? I have reason to say that they are cynically lying. The investigator who is sitting here has repeatedly admitted that another person, who is different in height, is in the video from me. A whole year of this lie and filth is painful and unfair. It is a horror towards families and children. They fooled my children with dates, the children sat dressed and waited, and they did not pick up the phone. I know all this, this is elementary bullying. Without any proof of involvement, they carry out criminal orders and persecute honest people.
